General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed at both consumers and traders. Provisions that apply expressly only to consumers or only to traders are marked accordingly.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A trader is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

In relation to traders, these terms and conditions also apply to future business relationships without our having to refer to them again. If the trader uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Formation of Contract, Correction Options

The purchase contract is concluded with Frederick Vincent Louis Hinsch.

By listing products in the online shop, we make a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text

Language(s) available for concluding the contract: German, English, French, Dutch, Spanish, Italian, Polish

We store the text of the contract and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Terms

Delivery Options

We ship products to the delivery address specified during the ordering process.

We only deliver by shipping. Unfortunately, self-collection of goods is not possible.

We do not deliver to parcel lockers.

Transfer of Risk for Traders

If the customer is a trader, the risk of accidental loss and accidental deterioration of the goods passes to the customer upon handover of the goods to the carrier.

5. Payment

The following payment methods are generally available in our shop.

You enter your credit card details during the ordering process. Your card will be charged immediately after the order is placed.

6. Retention of Title

The goods remain our property until paid in full. In relation to traders, we retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.

7. Warranty and Guarantees

7.1 Statutory Liability for Defects towards Consumers

If the customer is a consumer, the statutory liability for defects applies without restriction.

7.2 Liability for Defects towards Traders

If the customer is a trader, the statutory liability for defects applies with the following deviations:

  • The limitation period for claims based on defects is one year from delivery of the goods.
  • In the event of defects, we shall, at our discretion, provide remedy by repair or replacement delivery.
  • If the customer is a merchant within the meaning of the German Commercial Code (HGB), the duty to inspect and give notice of defects pursuant to Section 377 HGB applies. If the customer fails to give the notices provided for therein, the goods shall be deemed approved.

The above restrictions do not apply to claims for damages (Section 8 applies to these), in the case of fraudulent concealment of a defect, where a guarantee has been given, or to recourse claims pursuant to Sections 445a, 445b and 478 of the German Civil Code (BGB).

7.3 Guarantees and Customer Service

Information on any additional guarantees that may apply and their exact terms can be found with the respective product and on special information pages in the online shop.

8. Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in the event of injury to life, body or health,
  • in the event of an intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the German Product Liability Act (ProdHaftG) is applicable.

In the event of a slightly negligent breach of essential contractual obligations by us, our legal representatives or vicarious agents — obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the contracting party may regularly rely (cardinal obligations) — liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

9. Dispute Resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer, this choice of law applies only insofar as it does not deprive the customer of the protection granted by mandatory provisions of the law of the state of their habitual residence.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of performance for all obligations arising from this contract is the place of dispatch of the goods in Berlin, Germany, and the exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany.
